Trademark Infringement: Court Grants Relief to Finolex Cables Ltd.
In a significant legal victory, the Pune District Court has granted interim relief to Finolex Cables Ltd. in a trademark infringement and passing-off dispute. For over four decades, R. K. Dewan & Co. (RKD) has served as trusted legal counsel to Finolex, a company renowned for its electrical cables bearing the widely recognized “FINOLEX” trademark. The immense popularity of Finolex’s products, however, has made it a frequent target for counterfeiters, who have sought to capitalize on its reputation by marketing substandard cables under identical or confusingly similar brand names.
One such case of infringement prompted RKD, acting on behalf of Finolex, to file a lawsuit in the Pune District Court in January 2025. The suit targeted Mohan Electrical Works (MEW), an entity accused of unlawfully adopting the trademark “Finoflex,” which bore a striking resemblance to Finolex’s registered “FINOLEX” mark. This deliberate imitation, Finolex argued, constituted a clear violation of Finolex’s registered and well-recognized “FINOLEX” mark.
During the proceedings, RKD presented a compelling case, emphasizing that trademark infringement and passing off are not limited to the use of identical marks but extend to any similar branding likely to mislead or confuse consumers. After a thorough review of these arguments, the Pune District Court, in March 2025, ruled in favour of Finolex, issuing an ex-parte ad-interim injunction. This order effectively bars MEW from continuing to use the infringing “Finoflex” trademark, providing immediate relief to Finolex.
