R K Dewan & Co was honoured as the “Trademark Prosecution Firm of the Year – India” at the Global IP Awards 2024, held at the St Pancras Renaissance Hotel, London. We are grateful for this recognition and extend our appreciation to our clients and team for their continued trust and support.
Well-Known and Well-Protected

We are delighted to share that R K Dewan & Co. was successful in representing and securing the “Well-Known” trademark status for our client’s marks namely; NATIONAL STOCK EXCHANGE (NSE), COOPER CORPORATION, EMERSON, TSERIES, SAFE EXPRESS which have been included among a total of 55 marks in the esteemed "List of Well-Known Trade Marks" maintained by the Indian Trade Marks Registry.

The commercial benefits of holding a ‘well known’ trademark are tremendous, providing robust protection against infringement across all classes of goods and services. Once a trademark is declared as ‘well known’, by the Trade Marks Registry, it is bound under the law to not register any trademark that is identical with or similar to the well-known trademark across all classes of goods and services. During infringement proceedings, a well-known trademark can be asserted against defendants dealing in entirely different goods or services.

“Dominance” Denied
We delve into the nuances of the decision issued by the EUIPO - European Union Intellectual Property Office’s (Board of Appeal), wherein it rejected the registration for the mark "BADTORO" on the grounds that it incorporated the PDO "TORO" (used to protect Spanish wines) as its dominant part, thereby taking unfair advantage of its reputation and creating confusion. This article explores the nuances of trademark subsumation—when a new mark incorporates a recognizable or a dominant part of an existing mark, and the legal and practical considerations that lead to the rejection of such trademark applications.
